100. Prohibited munitions.

The Cluster Munitions (Prohibitions) Act 20101 makes provision for the control of cluster munitions. It gives effect to the Convention on Cluster Munitions2.

Munitions to which the Act applies are cluster munitions and relevant explosive bomblets3 (together 'prohibited munitions')4. A 'cluster munition' is a conventional munition that is designed to disperse or release explosive submunitions5 each weighing less than 20 kilograms, and includes those explosive submunitions6. The following are not cluster munitions:

    (1)     a munition or submunition designed to dispense flares, smoke, pyrotechnics or chaff; or a munition designed exclusively for an air defence role;
