An application for compensation may be made where a person claims that:
(1) any equipment or building has been destroyed1 or altered in compliance with a notice2 or has been destroyed or altered as a result of such a notice not being complied with3;
(2) he had an interest which was materially affected by the destruction or alteration and he sustained loss as a result4; and
(3) no copy of a notice was served5.
