581. Rights of a person who takes no part in arbitral proceedings.

A person alleged to be a party1 to arbitral proceedings but who takes no part in the proceedings may question2:


    (1)     whether there is a valid arbitration agreement3;


    (2)     whether the arbitral tribunal4 is properly constituted5; or


    (3)     what matters have been submitted to arbitration in accordance with the arbitration agreement6,

by proceedings in the court7 for a declaration or injunction or other appropriate relief
