549. Consolidation of arbitral proceedings and concurrent hearings.

549.     Consolidation of arbitral proceedings and concurrent hearings.

The parties1 are free to agree that the arbitral proceedings be consolidated with other arbitral proceedings, or that concurrent hearings be held, on such terms as may be agreed2. Unless the parties agree to confer such power on the arbitral tribunal3, the tribunal has no power to order consolidation of proceedings or concurrent hearings4.

In relation to a statutory arbitration5, this power applies only so as to authorise the consolidation of proceedings, or concurrent hearings in proceedings, under the same enactment6
