A person who for the purpose of killing or taking hares or rabbits uses or knowingly1 permits the use of a spring trap2 elsewhere than in a rabbit hole3 is guilty of an offence4 unless the trap is used in circumstances and subject to conditions prescribed by regulations made by statutory instrument by the appropriate authority or under and in accordance with a licence granted by them
