323. Exceptions to unlawful methods of killing or taking wild birds.

None of the offences relating to unlawful methods of killing or taking wild birds1 is committed by an authorised person2 who uses a cage-trap or net for the purpose of taking a wild bird3; nor by any person who uses nets for the purpose of taking wild duck in a duck decoy which is shown4 to have been in use immediately before 4 June 19545; nor by any person who uses a cage-trap or net for the purpose of taking any game bird if it is shown that the taking of the bird is solely for the purpose of
