A failure by any person to comply with any provision of a code issued by the appropriate authority or approved by him under the provisions of the Animals (Scientific Procedures) Act 19861 does not of itself render that person liable to criminal or civil proceedings; however, any such code is admissible in evidence in any such proceedings and, if any of its provisions appears to the court to be relevant to any question arising in those proceedings, it must be taken into account in determining that question
