35. Domestic animals as subjects of theft.

At common law, domestic and tame animals, such as horses, cattle, oxen, sheep, poultry, peacocks, and all animals which are fit for human food, and their young and eggs, were the subject of larceny1. Dogs of all kinds, cats and animals of base nature were exceptions2.

By statute, however, all animals which have value and are the property of any person can be the subject of theft
