229. Destruction orders otherwise than on a conviction.

Where a dog is seized1, and it appears to a justice of the peace:

(1)     that no person has been or is to be prosecuted for an offence under the Dangerous Dogs Act 1991, or under an order made under that Act2 in respect of that dog, whether because the owner cannot be found or for any other reason3; or

(2)     that the dog cannot be released into the custody or possession of its owner without the owner contravening the prohibition on possession of dogs bred for fighting
