228. Contingent destruction orders.

The court has the power to make contingent destruction orders1. Where:


    (1)     a person is convicted of an offence relating to prohibited fighting dogs, other specified dangerous dogs or dogs dangerously out of control2;


    (2)     the court does not order the destruction of the dog3; and


    (3)     in the case of an offence relating to fighting dogs, the dog is subject to the prohibition on possession of the dog
