285. The tribunal.

The Plant Varieties and Seeds Tribunal1 has been established to hear appeals against decisions of the Controller of Plant Variety Rights2 and to hear and determine any matter agreed to be referred to the tribunal by any arbitration agreement relating to the infringement of plant breeders' rights or to matters which include the infringement of plant breeders' rights3.

The tribunal consists of a chairman4, who must have a seven year general qualification5, and members selected from panels which are drawn up and revised from time to time by the Secretary of State and the Welsh Ministers6. One panel consists of
