The Controller of Plant Variety Rights1 may terminate the period for which a grant of plant breeders' rights2 has effect3 if he is satisfied that the protected variety4 is no longer uniform or stable5, or it appears to him that the rights holder is no longer in a position to produce to the Controller propagating material capable of producing the protected variety6, or he is satisfied that the rights holder has failed to comply with a request aimed at establishing whether he is in such a position
