268.     Scope and conditions of patent licences.

Compulsory patent licences1 may be granted only in so far as they are necessary for the exploitation of the new plant variety2 in connection with which the application was made3. Licences must not be exclusive4, must entitle the proprietor of the patent concerned to an appropriate royalty5, and must entitle the proprietor of the patent concerned to a cross licence on reasonable terms to use the new plant variety6, and may in addition be granted on such other terms as the Controllers
