The Secretary of State1, where he is satisfied that it is necessary or expedient so to do in the interests of protecting wild birds2 or wild animals3 from harm4, may make an order prescribing ingredients contained in pesticides5, and a person is guilty of an offence (subject to specified statutory defences6) if he has in his possession a pesticide containing an ingredient which has been so prescribed
