Any term of a contract between a licence holder1 and a labour user2 which is contingent on a worker3 taking up employment with the labour user or working for the labour user pursuant to being supplied by another licence holder is in general unenforceable by the licence holder in relation to that worker, unless the contract provides that instead of a transfer fee4 the labour user may by notice to the licence holder elect for a hire period of such length as is specified in the contract during which the worker will be supplied to the labour user:
