338.     Prohibition on withholding payment to workers.

A licence holder1 may not withhold or threaten to withhold the whole or any part of any payment due to the worker2 in respect of any work done by the worker on grounds of:

  1.  

    (1)     non-receipt of payment from the labour user3;

  2.  

    (2)     the worker's failure to prove that he has worked during a particular period of time4;

  3.  

    (3)     the worker not having worked during any period other than that to which the payment relates5; or

  4.  

    (4)     any matter within
