E. Protection of Existing Rights

256.     Plant breeders' rights granted under previous legislation.

Plant breeders' rights were formerly granted in respect of plant varieties of such species or groups as were prescribed by a scheme1 made under the Plant Varieties and Seeds Act 19642. Such of those rights as were exercisable on 8 May 19983 continue to have effect and are subject to the new statutory provisions for the protection of plant variety rights4 to the same extent5 as are rights granted pursuant to those provisions6.
