390. Ministerial powers and functions in respect of agricultural production and marketing.

Powers and functions in respect of agricultural production and marketing in England and Wales are exercised primarily by the Secretary of State for Environment, Food and Rural Affairs1 or, in Wales, by the Welsh Ministers2.

In discharging any functions connected with agriculture3 in relation to any land the Secretary of State and the Welsh Ministers must, so far as is consistent with the proper and efficient discharge of those functions, have regard to and endeavour to achieve a reasonable balance between:

    (1)     the promotion and maintenance of a stable and efficient agricultural industry4;
