387.     Levy on horticultural products.

Consequent to the UK's withdrawal from the EU, this Halsbury paragraph should be read in conjunction with the Common Agricultural Policy and Agriculture and Horticulture Development Board (Amendment etc) (EU Exit) Regulations 2019, SI 2019/733, pending incorporation of the changes into the text.

Any person must pay a levy if he grows the following horticultural products:

  1.  

    (1)     all vegetables grown in the open and sold for human consumption, including watercress but excluding potatoes;

  2.  

    (2)     all soft fruit and orchard fruit, including nuts but excluding:

    1.  

      (a)     varieties of apples certified as cider apples, and
