(1)     Application of Environmental Protection Legislation to Agriculture

358.     Introduction.

A number of specific statutory provisions have been enacted for the purpose of restricting or reducing the polluting effect of agricultural operations1. Particular provision is made for:

(1)     controlling statutory nuisances arising from the emission of smoke, fumes or gases from agricultural premises2;

(2)     prohibiting the unlicensed burning of heather, rough grass, bracken, gorse or vaccinium3;

(3)     prohibiting and restricting the burning of crop residues on agricultural land4;

(4)     offences involving the lighting of
