Except in the case of land forming part of an operational railway, Natural England or the Welsh Ministers (as appropriate)1 may grant a licence for burning heather, rough grass, bracken, gorse or vaccinium2 outside the burning season3 only4 if it is satisfied that the proposed burning is necessary or expedient for the conservation, enhancement or management of the natural environment for the benefit of present and future generations or the safety of any person5.
