Any person who, in relation to any variety1, falsely represents that he is entitled to exercise plant breeders' rights2, or any rights derived from such rights, knowing that the representation is false, or makes such a representation recklessly, is guilty of an offence3. It is immaterial for these purposes whether or not the variety to which the representation relates is the subject of plant breeders' rights4.
