An authorised officer1 may, at any time, give written consent3 to the movement of controlled horticultural produce2 and to the lifting of the stop notice3. An authorised officer must, upon request, give written consent to the movement of controlled horticultural produce and to the lifting of the stop notice if the following circumstances apply4.
The circumstances are where:
(1) the authorised officer is satisfied that no offence under provisions relating to the marketing of fresh fruit and vegetables5 would be committed in respect of the horticultural produce if it were sold in circumstances in which EU marketing rules6 apply7; or
