It is an offence, punishable by a fine, to contravene any of the health and safety regulations1, although it is generally a defence for a person charged with a contravention of any of the regulations to prove that he used all due diligence to secure compliance2. A breach of the regulations will not give rise to civil liability except in so far as the regulations provide3. These provisions bind the Crown4.
