Where either or both of the Secretary of State and the Welsh Ministers1 is, or are, of the opinion that a person is a manufacturer2 placing on the market3 fertiliser4 that does not comply with the relevant EU Regulation5, but that person has not committed an offence under the relevant implementing legislation6, the Secretary of State and the Welsh Ministers may each serve a notice in writing on the person in question giving reasons why he is, or as the case may be, they are of that opinion and requiring that person to take such steps as are specified
