The Controller of Plant Variety Rights1 may suspend the exercise of any plant breeders' rights2 if he is satisfied that the rights holder3 is in breach of any obligation imposed on him by the licence4, and may terminate such a suspension only if, on application by the rights holder concerned, he is satisfied that the holder is no longer in breach of the obligation whose breach led to the suspension5. A decision of the Controller to allow or refuse an application for the suspension of rights or the termination of such a suspension is subject to appeal to the
