Parties who wish to refer a matter for third party determination1 under the Agricultural Holdings Act 1986 must jointly appoint a third party to determine the matter2. However, they may not jointly appoint a third party to determine a matter once an arbitrator has been appointed3 either by agreement between them or by the president of the Royal Institution of Chartered Surveyors4.
