In relation to certain tenancies of agricultural holdings1 provision is made by the Agricultural Holdings Act 19862 governing the succession to such tenancies on the death of a sole or sole surviving tenant3 or on the retirement of the tenant or tenants4. In order for those provisions to apply the tenancy must either have been granted before 12 July 19845 or have been granted after that date in any of the following circumstances:
(1) the tenancy is already a succession tenancy, that is a tenancy granted by virtue of a direction of the Tribunal6 on the death or retirement
