Land1 let2 by a district, parish, London borough, or, in Wales, a community, county or county borough council3 for use as an allotment must be let at such a rent as a tenant4 may reasonably be expected to pay for the land if let for such use on the terms (other than terms as to rent) on which it is in fact let5, although the council may let such land at a lesser rent if it is satisfied that there exist special circumstances affecting the person to whom it is to be let which render it proper for it
