A succession may take place by agreement where the landlord1 and tenant2 agree that the tenant should retire and a new tenancy be granted3, or the existing tenancy assigned4, to a person who at that time would have been a close relative5 had the tenant died immediately before the relevant grant or assignment6. There is no requirement that the tenant should have reached retirement age and the close relative does not have to satisfy the other tests for eligibility or suitability: this arrangement is deemed for the purposes of the two succession rule
