588. Disclaimer by tenant's trustee in bankruptcy.

The trustee in bankruptcy of a tenant has power to disclaim the tenancy1. If a trustee in bankruptcy of a tenant sells hay, etc, off the holding without returning manure as required by the custom of the country or by the terms of the contract of tenancy, and then disclaims the tenancy, he becomes personally liable to the landlord for his wrongful act2.

In the absence of any order of the court dealing with such matter, when the trustee in bankruptcy of a tenant disclaims the tenancy he is not entitled to be paid for fallows, etc
