Where a contract of tenancy, not being a farm business tenancy1, in respect of an allotment2 or allotment garden3 is made with a mortgagor but is not binding on the mortgagee, the tenant4 is entitled, if deprived of possession by the mortgagee, to recover compensation5, including compensation for disturbance6, from him as if he were the landlord7 and had terminated the tenancy, but subject to the deduction from the compensation of rent or other sums due from the tenant
