A smallholding1 which comprises land which is used for agriculture2 and which is so used for the purposes of trade or business, or land which is designated by the Secretary of State or the Welsh Ministers3 as agricultural land for the purposes of the Agriculture Act 1947, is subject to the provisions of that Act, which are principally concerned with securing efficiencies in estate management, husbandry and production4.
A smallholding which is, or which is comprised in land the aggregate of which (whether agricultural land5 or not) is, comprised in a contract of tenancy6 entered into before 1 September 19957
