If the attorney under an enduring power1 has reason to believe that the donor is or is becoming mentally incapable2 he must as soon as practicable make an application to the Public Guardian3 for registration of the instrument creating the power4. Before making such application, the attorney must comply with the provisions as to notice5 and may refer to the court6 for its determination any question as to the validity of the power7 and must comply with any direction given to him by the court on
