242.     Making a guardianship order.


The High Court2 has jurisdiction to hear and determine an application for a guardianship order3 in relation to property or financial affairs of a missing person4 only if:

(1)     the person was domiciled in England and Wales on the day before he or she was first known to be missing5;

(2)     the person had been habitually resident in England and Wales throughout the period of one year ending with that day6; or

(3)     the application is made by the person's spouse or civil partner and the applicant is either domiciled in England and Wales on
