No agent, who is in possession of property which his principal holds in trust for another1 and who makes, on the instructions of his principal, any disposition of such property which is inconsistent with the trust, is guilty of a breach of trust2, unless he had notice of the trust at the time3 and was aware that the disposition made by him was in breach of trust4.
