55 Release of powers

In some circumstances it may be desirable to release a power, either in its entirety or as to particular objects or property. A total release might be desirable in order to render the interests of those entitled in default indefeasible1. A partial release might be used so as to exclude the settlor from the class of potential appointees, thereby avoiding the reservation of benefit rules for the purpose of inheritance tax2 and also preventing income from the settlement being treated as income of the settlor for the purpose
