45 Powers of soldiers, sailors and airmen

A soldier or airman in actual military service, or a mariner or seaman at sea (including a member of Her Majesty’s naval or marine forces who is in such a situation that if he were a soldier he would be in actual military service) can, by a nuncupative will, exercise powers of appointment, whether general or special, over both personal1 and real2 property3; this applies even though he is a minor4.
