82 Water pollution in the minerals industry

It is, as a general rule, an offence to cause or knowingly permit a ‘water discharge activity’ or ‘groundwater activity’ as those terms are defined in regulations1. The offence is causing or knowingly permitting any poisonous, noxious or polluting matter, waste matter or trade effluent to enter any inland fresh waters, coastal waters or relevant territorial waters unless expressly allowed, for example by a prescribed statutory provision.

Mining wastes are now regulated by the EU Mining Waste Directive2 and by regulations3.
