72 Notice of subsidence damage caused by coal mining

The person with responsibility for subsidence is not required either to execute works or to make any payment under the Coal Mining Subsidence Act 1991 unless the owner of the damaged property, or some other person who is liable to make good the damage in whole or in part, has given to the responsible person a ‘damage notice’, and has afforded that person reasonable facilities to inspect the property, so far as he was in a position to do so1.
