49 Use of water and discharge into controlled waters by mineral operators

There is a general statutory prohibition on the abstraction of water from any source of supply, or the impounding of any water in an inland water, except in pursuance of a licence granted by the Environment Agency or Natural Resources Wales and in accordance with the provisions of that licence1. Where the abstraction of water contained in any underground strata is so prohibited except in pursuance of a licence, there is also a prohibition on the construction or extension of any well, borehole or other work whereby water
