44 Exceptions and reservations in demises of mines, minerals, landfill rights

It is usual in a demise of mines and minerals or landfill rights to make certain exceptions and reservations in favour of the landlord. These are usually intended either for the protection of the demised mines and minerals or the surface lands, or for the preservation of the landlord’s right to work other minerals.

In framing an exception, care must be taken to avoid any doubt as to whether it is to operate as an exception from the grant of mines and minerals or from the liberties granted1. The exceptions
