35 Registered land—transfer of mines and minerals

A proprietor of registered land may, in the prescribed manner, subject to any entry to the contrary on the register1, transfer all or any mines or minerals apart from the surface2. If the registered title consists only of the mines and minerals, application should be made to complete the transfer in the usual way by the entry of the transferee on the register as proprietor3. If the transferor has a title to freehold or leasehold land which contains a note that the mines and minerals are expressly included4, a transfer of the mines
