34 Conveyance on sale of mines and minerals

All mines and minerals, whether or not the ownership of them is severed from the ownership of the surface of the land, lie in grant and are conveyed by deed1. Unless they are expressly excepted or the circumstances exist to rebut the normal presumption, mines and minerals will pass without specific mention on a conveyance of land2.

In relation to former copyhold land, a conveyance of a manor passes the mines, minerals and quarries reported or known as part of the manor unless expressly excepted3.
