19.9 Absence of counter-notice to mine owner

In the absence of a counter-notice, or so far as the counter-notice does not extend, the mine owner may, after the expiration of the 30 days’ notice of approach, work the minerals within the designated area1. A mine owner who works the minerals in the manner which is proper and beneficial for their working and in accordance with the usual manner of working such minerals in the district, is under no liability to the undertakers for withdrawal of support2, except that, in the case of the railways substituted code,
