19.8 Compensation when prevented from working minerals

The measure of compensation for the mines and minerals that the mine owner is prevented from working is ‘what the mine owner would have made out of the minerals during the time it would have taken him to work them, if he had not been so prevented1; and which may include compensation for the loss of void space created by the winning of the minerals; that is, the net profit after deduction of the costs of working, including any liability for damage to the surface the mine owner would have incurred
