19.6 Notice of approach by mine owner

The owner, tenant or occupier (the ‘mine owner’) of any mines or minerals lying under the works of the undertakers or within a prescribed distance from them1 who wishes to work those mines or minerals is put under an obligation to give the undertakers 30 days’ notice in writing of his intention to do so, before commencing to work them2. The notice is not rendered invalid merely because the mine owner does not intend to act upon it at once, so long as he has a genuine intention of working
