13 Compulsory acquisition of minerals or right to work

Compulsory acquisition of minerals or the right to work the same can arise in the following circumstances:

  1. 13.1

        where land is compulsorily acquired by a government department or statutory undertaker for certain purposes which require the acquisition of the underlying minerals either for support or for use in connection with the construction of the structure to be placed on the land1;

  2. 13.2

        where the right to work minerals, or to have ancillary rights which allow for the working of those or other minerals, cannot be acquired by agreement between the owner
