9 Rent and markets

Although rent may issue out of a market place and may be enforced by CRAR (commercial rent arrears recovery), rent cannot issue out of an incorporeal hereditament, such as a market franchise right, so as to be recoverable by that method1. It follows, therefore, that a letting of a market and market place at an entire rent will not enable enforcement by CRAR for the rent reserved, as it is impossible to say how much is due in respect of the market rights and how much in respect of the market place.
