17 Duty to hold market

A franchise is granted on the implied condition that it is duly exercised according to the grant and, if the condition is broken, the franchise is liable to confiscation1. However, it appears that there is no obligation to hold any market which has become unfrequented and useless, and the market right is unaffected2. A market created by franchise cannot be abandoned3.
